1. Overview

Wigtoy LLC ("Wigtoy," "we," "us," "our") is a Utah limited liability company that operates wigtoysoftware.com and a family of digital products and services. By accessing or using any website, application, or service operated by Wigtoy LLC, you ("you," "your") agree to these Terms & Conditions. If you do not agree, you must discontinue use of our services.

2. Services

Wigtoy LLC operates multiple products and services, including but not limited to:

• Wigtoy Software (wigtoysoftware.com) — custom software engineering and consulting.
• RNG Water Alerts (rngwater.com) — water utility notification service delivering alerts via email, SMS, and voice.

Additional services may be introduced over time. Service-specific terms, where applicable, will be presented within the relevant product and are incorporated by reference into these Terms.

3. Communication Services

Certain Wigtoy LLC products deliver notifications via email, SMS, and/or automated voice calls. The following terms apply to all communication-enabled services:

a. Email

By providing your email address and enabling email notifications, you consent to receive service-related emails. These may include service alerts, account notifications, and operational updates relevant to the product you are using.

b. Text Messages (SMS)

By providing your phone number and opting in to SMS notifications, you expressly consent to receive autodialed text messages at the phone number you provide. You understand that:

• Message frequency varies based on service events relevant to your account.
• Message and data rates may apply. Consult your wireless carrier for details about your messaging plan.
• You can opt out at any time by replying STOP to any message, or by disabling SMS in your notification preferences.
• Reply HELP for assistance or contact us at the information below.
• SMS is not required to use any Wigtoy LLC service or to purchase any goods or services.
• Carriers are not liable for delayed or undelivered messages.
• Compatible carriers include but are not limited to AT&T, T-Mobile, Verizon, and Sprint. Service may not be available on all carriers.

c. Voice Calls

By providing your phone number and opting in to voice notifications, you expressly consent to receive automated and prerecorded voice calls at the phone number you provide. You understand that:

• Calls may be made using an automatic telephone dialing system or prerecorded voice technology.
• Call frequency varies based on service events relevant to your account.
• Standard call charges from your carrier may apply.
• You can opt out at any time by disabling voice notifications in your notification preferences.
• Voice calls are not required to use any Wigtoy LLC service or to purchase any goods or services.

4. Consent

By checking an "I have read and agree to the Terms & Conditions" box during registration and/or enabling notification channels in your preferences on any Wigtoy LLC service, you provide your prior express written consent (as defined by the Telephone Consumer Protection Act, 47 U.S.C. § 227, and its implementing regulations) to receive communications through the channels you select. This consent is not a condition of purchasing any property, goods, or services.

5. Opting Out

You may withdraw your consent and opt out of communications at any time through any of the following methods:

• SMS: Reply STOP to any text message you receive from us.
• Online: Log in to your account and disable channels in your notification preferences.
• Email: Contact us at the address below to request removal.
• Account Deletion: Deleting your account will immediately withdraw all communication consent.

Opt-out requests are processed immediately. You may still receive transactional messages related to your account security (e.g., password resets).

6. Data Usage & Privacy

We collect and use your information solely for the purpose of operating the services you have signed up for. 7. Disclaimers

• All services and notifications are provided on an "as-is" basis. While we strive for timely delivery, we cannot guarantee that all messages will be delivered successfully or without delay.
• Notification services supplement but do not replace official public safety notifications. In an emergency, always follow instructions from local authorities.
• We are not responsible for charges incurred from your wireless carrier for receiving messages or calls.
• We reserve the right to modify the frequency or content of notifications at any time.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Wigtoy LLC and its members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to missed or delayed notifications.

9. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.

10. Changes to These Terms

We may update these Terms & Conditions from time to time. When we do, we will update the version number and effective date at the top of this page. Continued use of any Wigtoy LLC service after changes are posted constitutes acceptance of the updated terms. Material changes may require renewed consent.
